4. He's got a judgement on top of that for additional penalties of $22,500+. They are bleeding him of every last penny

Interesting that Brian Kos (the real kingpin who played David like a banjo in Deliverance) only got 45 months. He actually got two (2) 45 month sentences but running them concurrently means straight 45.

But wait…he also got recommended for the drug treatment program so if he completes that program he’ll get about 12 months off. Short of it—he does 85% of 45 months and gets 12 off for rehab if he does the rehab so could be as little as 26-27 for him

We know David was sentenced, but the documents and the pleadings are still under seal. We know the number, but until we can post the corroborating document, nothing will go up. The big question is, was David Hagen there? Oh wait, no, he's in jail on multiple counts of fraud, money laundering, securities fraud and generally being an asshole.

The amazing thing is that Annette was there. Inked up, ridiculous fake boobs and whatever new boy toy she's got banging that tired body apparently didn't exclude her.

In typical Hagen "style", Julia Karcher and Derek Hagen's wedding on Saturday September 19, 2009 at The Castle McCulloch in Jamestown, NC. The ceremony was held at 11am alongside the lake next to the castle.

The Bridal party came into U2's "Beautiful Day" and the ring bearer came into the Star Wars Dark Vader Theme while holding onto a lightsaver. Julia and Derek walked into Counting Crows "Accidentally in Love" followed by their first dance by Marc Cohn "True Companion". Julia danced with her father, Robert, to Jessica Simpson's "You don't have to let go" while Derek danced with his mother, Annette, to Bette Midler's "Wind beneath my wings". Julia's Papa, Robert, gave the blessing before the luncheon buffet was served with all the sweat tea one could ever imagine.

The Maid of honor, Jackie Karcher, and bestman, Leland Parker, gave toasts that had everyone cracking up. Even Julia's father, Robert, gave a hilarious thank you toast that started off by saying "When I first met Derek, I thought he was the school janitor". The cake cutting was cut to Pat Benetar's "Hit me with your best shot".

Take a look at the cake topper on their wedding cake. It was AWESOME! The girls came out to Cyndi Lauper "Girls just want to have fun" while Derek took off the garter to "Mission Impossible" and threw it to the guys while Queen's "Another one bites the dust".

Hagen Faces Prison for Securities Fraud

A former Southern Pines businessman is waiting to be sentenced after a federal court in Charlotte convicted him on fraud charges.
The jury found David A. Hagen guilty of conspiracy to commit securities fraud, conspiracy to commit wire fraud and conspiracy to commit money laundering.
No date has been set for sentencing, the clerk of court for the Charlotte office of the Federal District Court for Western North Carolina said Thursday. Hagen was indicted in December as "David A. Hagen a/k/a David DeFusco, David DuFusco, David Allen Hagen DuFusco, and Antonio," according to court documents and convicted May 15, 2009.
A co-defendant, Brian Kos, (described in the indictment as "a longtime stock promoter") and Hagen were accused of using false statements in press releases and Web sites to drive up the price of stock for GTX Global, formerly known as Gatelinx Corp.
Unindicted co-conspirators named in the indictment included Mark E. Brecher of Naples, Fla. (secretary-treasurer of GTX Global) and Howell and Vernice Wolz.
Earlier this week, Sam Currin, a former federal prosecutor and judge, was released from prison early in return for his cooperation in the Hagen case. U.S. District Judge W. Earl Britt ordered Currin -- a Raleigh attorney and former aid to Sen. Jesse Helms -- released. Britt, who presided over Hagen's trial, reduced Currin's sentence to time served. Currin had been in federal prison since May 2007. His original release date was not until April, 2013. Currin was named in the Hagen case as an unindicted co-conspirator. Currin admitted to laundering $1.3 million for Hagen.
Hagen formerly operated PrimeTV, a satellite television sales company out of the former Winn-Dixie supermarket building off U.S. 1 between Southern Pines and Aberdeen. There were many complaints against PrimeTV for failure to pay reimbursements and it was fined by the Attorney General's office.
After losing the DirecTV franchise for also selling competing DISH systems, Hagen reorganized his business as Gatelinx Corp., later GTX Global. Hagen claimed to be developing high-definition Internet movie delivery and other innovative technologies and would show visitors such a purported system appearing to operate on a big-screen televisions. He claimed to be developing artificial intelligence systems.
His office walls displayed a collection of antique weapons. Hagen and his wife, Annette, had served time for bankruptcy fraud under the name DeFusco. Several Washington Post articles chronicled their extravagant lifestyle prior to their arrest. Blaming the conviction on some bad business decisions, the Hagens said they were starting over when they moved to Southern Pines.
Gatelinx fought off one lawsuit after another. The Hagens abandoned plans to restore The Jefferson Inn -- now restored by a different owner. They moved offshore. They were said to be divorcing.
A new company, SRS Prayer Services, set up shop behind the Food Lion on N.C. 5 but closed its doors last year. It claimed to have nothing to do with the Hagens, but Federal Express envelopes addressed to Annette Hagen could be seen on the counter waiting for pickup. FBI agents arrested Hagen in October 2007 after he got off a plane in New York from the Bahamas. In an affidavit filed with his arrest warrant, Hagen was accused of using erroneous Web sites purporting to give tips to drive up the stock price of GTX Global so he could sell his stock.
He was also accused of issuing a false press release claiming that GTX merged with another technology company. The affidavit calls it a "classic pump-and-dump" scam. The indictment on which Hagen was convicted accused him of selling stock at its inflated price and then laundering the money through bank accounts in the Bahamas, the Netherlands and Cyprus and finally the United States.
An affidavit by FBI Special Agent Douglas P. Curran mentions a cooperating witness for the prosecution who recorded phone conversations with Hagen in which they discussed the scheme. Britt referred to Currin's extensive cooperation with federal prosecutors in his decision to release Currin early, according to a story in Tuesday's News & Observer of Raleigh. In court, federal prosecutors said Hagen used a number of Web sites to drive up the price of GTX Global stock price, sold the stock at inflated prices and then launder his profits through bank accounts in the Bahamas, the Netherlands, Cyprus and the U.S. Criminal prosecutors first began looking into GTX Global as part of their investigation of two other penny stock companies called Concorde America Inc. and Absolute Health and Fitness Inc. according to a Dow Jones report.
The jury ordered Hagen to forfeit almost $28 million in proceeds from his illegal acts. He faces a maximum sentence of 45 years in prison. Other investigations by the Securities and Exchange Commission in Florida and the FBI in Charlotte led to a number of other arrests connected with the GTX Global stock scheme, including Currin.
A number of plea agreements made with other individuals in the case are expected to be unsealed soon, including one with co-defendant Kos. Others could include former GTX lawyer (and SRS Prayer Services president) Edward C. Ovsenik. There could be indictments naming Hagen's wife and others, Dow Jones said.

Witness in Hagen Case Released Early

A former federal prosecutor and judge was released from prison early for his cooperation in a federal court case against David A. Hagen, a former Southern Pines resident.

Sam Currin was released Monday by order of U.S. District Judge W. Earl Britt. Currin, a Raleigh lawyer who rose to prominence as an aid to Senator Jesse Helms, had been in federal prison since May 2007. He was not originally scheduled to be released until April 2013.

Currin admitted to laundering $1.3 million for Hagen, who was convicted in federal court in May of three counts of conspiracy to commit securities fraud, conspiracy to commit mail/wire fraud and conspiracy to commit money laundering. He has not been sentenced on those charges yet.

Currin served as U.S. attorney for the Eastern District of North Carolina from 1981 until 1987. From 1987 until 1990 he a Superior Court judge and from 1996 until 1999 he served as the state's Republican Party chairman.

Hagen was arrested by FBI agents in October 2007 after he got off a plane from the Bahamas in New York. As part of the plea agreement (still sealed) Mark Brecher had to forfeit a large sum of cash. Not as big as David Hagen's, um, I mean Keri Keenan Hagen's cash, but still big enough to hurt. But, not big enough so that he couldn't WRITE A CHECK FOR THE FULL AMOUNT.

This next document is VERY interesting. Based upon Brecher's help, the government is recommending a sentence reduction. He's pleaded out and will now serve 140 months for 2 consecutive sentences. 12 FUCKING YEARS. (If anyone thinks David is gonna get out before he is old, gray, a complete jail-house faggot, has grandchildren with Andrea and her 3 ex-husbands, and the new slimmer Derek after gastric bypass surgery, you're dreaming. "Brecher has provided information with regard to the Yadio merger that differs materially from certain documentation and the testimony of other witnesses. However, the Government is satisfied that these discrepancies are not due to an intentional effort on the part of Brecher to provide false or misleading information."

David Hagen, founder and former president of GTX Global Corp. (GTXC), has been convicted of conspiracy to commit securities fraud, conspiracy to commit wire fraud and conspiracy to commit money laundering.

Hagen, a convicted felon who served time in jail for his involvement in a direct mail scheme in the late 1980s, was featured in a Dow Jones Newswires "In the Money" column in December 2005 cautioning investors about GTX Global. He had fled to the Bahamas and was arrested upon his return to the U.S. in 2007.

Federal prosecutors for the western District of North Carolina accused Hagen of using a number of Web sites to drive up the price of GTX Global' stock price, selling stock at inflated prices and laundering his profits through bank accounts in the Bahamas, the Netherlands, Cyprus and the U.S.

As first reported by Dow Jones in April 2006 (actually, first reported here in this blog), criminal prosecutors first began looking into GTX Global as part of their investigation of two other penny stock companies called Concorde America Inc. and Absolute Health and Fitness Inc.

Hagen has been ordered by the jury to forfeit almost $28 million in proceeds from his illegal acts. He faces a maximum sentence of 45 years in prison. (Good luck, Keri "I had to fuck the fat fucker but I took all the money" Keenan already, by David's own admission, taken the money)

Parallel investigations by the Securities and Exchange Commission in Florida and the Federal Bureau of Investigation in Charlotte, N.C., led to several GTX Global-related arrests, including that of former U.S. attorney Sam Currin who pleaded guilty to money laundering and obstruction charges. Currin was sentenced to 70 months in jail in 2007.

NOW COMES THE FUN. Brecher's plea agreement likely to be unsealed soon. Bryan Kos' plea agreement to be unsealed as well. But the court said, not so fast and David's attorney is being forced by the court to continue representing the once and future felon, David Hagen.

In an utterly predictable effort, David Hagen, facing 20+ years in federal prison and having already served an unbelievable 545+ days in Mecklenberg County Jail, has fired his attorney.

In a 17 page, handwritten brief to the court, David claims

1. His first attorney was incompetent and he fired him (WRONG fat fuck, as detailed in this blog and in publicly filed documents, Shanahan fired you for being stupid)

2. His second attorney has ignored him, failed to take legal advice from David (that's shocking) and has not pursued legal means to force either a speedy trial or a dismissal of the indictments. (WRONG again, as detailed here you're legal wranglings which you tried before and they didn't work and didn't work this time are the source of the delays)

3. His wife liquidated all the assets and skipped out on him leaving him indigent (and heartbroken so he fell into the arms of bubba) after his arrest created an opportunity, I mean hardship for her.

4. He's faced intolerable conditions with the "denizens" who reside in the county jail leaving him sleeping on a hard floor for 2 hours a night and fearing for his life. (David is a card carrying racist, so it's particularly amusing to know he's in a facility that is 90+% black)

5. Wants to be a samurai and fall on his own sword (Didn't fat schmoo Derek get the sword collection?)

Here's the most amazing fact. DAVID CAN STILL CUT A DEAL. Bryan Kos is a big fish and is still out there. There is the whole Chicago contingent from the Yadio fraud attempt (messr's Green, et al). There is the remaining Ed Ovsenik, Curtis Garth, Ivan Ivanov, Annette Louise Brown DeFusco Hagen group, and others too. There are the "advisors" and CFO's (the parade of co-conspirators) and more.

David could have probably gotten a deal for 3 years and just rolled over on these other criminals. But, his ego and his lack of any real intelligence have made that unlikely. The US Attorney's office hates Hagen and are gonna see him put in jail for a long long time. Plus, we have the still sealed Mark Brecher plea agreement that is probably going to eat into David's marketability with regards his plea opportunities.

David Hagen continues to be an enigma. Those of us here in this blog that knew him shake our collective heads in wonder.

Meanwhile, his family lives with the shame and legacy that only time and (as in the case of Derek) a few donuts will cure.

GOVERNMENT WINS ROUND 2 versus HAGEN

The US Attorney has spanked down David Hagen's attempt at a "do over" for the statements and admissions in his plea agreement. See the previous posts here (dated 10/16, 10/19, and 11/26 among them) in the blog detailing how Hagen tried, had a flawed strategy, how the government responded and now is 2 for 2 in its recent dealings with Herr Hagen.

Now, not only are the affidavits from the banks, bankers and processors admissible as corroboration to the governments wire taps and documents, but David's own statements and admissions made freely and openly to try and cut a deal are also admissible.

In this final ruling, the plea agreement David freely entered into and signed on 10/22/2007, but then tried to take back (as document here he tried... and failed... once before with this tactic) is fully admissible in the proceedings in front of David.

Note, no equivocation from the judge

"In sum, the parties reached a binding plea agreement. Defendant subsequently cooperated in furtherance of that agreement. Defendant refused to enter a plea of guilty. As a result, he breached the plea agreement, and in such a case, under the terms of the agreement, the government is entitled to use in its case-in-chief defendant’s admission of guilt therein and his debriefing statements."

Yes, it's true. David Hagen has been indicted, again, by Federal Grand Jury on 3 (THREE) more additional counts of

CONSPIRACY TO COMMIT MONEY LAUNDERING

So what you ask? That's like saying Derek Hagen has put on a few extra pounds. When you're as screwed as Hagen, who the fuck cares if he gets screwed more?

Well, read the indictment, there are some interesting new additions.

Down on page 15, in paragraphs 114 and 115, are the newest gems. They note, specifically, the Pink Sheets BULLSHIT filing of a 15c2-11 and all the other BULLSHIT press releases about Yadio. (see all the posts here in the blog detailing how, as far back as March of 2006 and several more detailed posts throughout this blog, the filings and ALL the press releases were BULLSHIT)

The government is using these filings and press releases to further indict Hagen. But, remember, it was EDWARD C OVSENIK who was listed as the executive on all the filings and press releases, was quoted in all the press releases, and who posted notes in investment blogs about the viability of the company and it's information and then had the audacity to have that whole press release thread about having a new finance team. (which turned out to both be BULLSHIT and that they were his buddies from his past employer... see the posts in this blog detailing all this too)

If the government is using these as documentation as to the overt acts of fraud, and the furtherance of the conspiracy to commit fraud, then ED OVSENIK is a dead man walking. . They presented this evidence to the grand jury and indicate "persons known and unknown to the grand jury" in this indictment. (Ed Ovsenik and Ivan Ivanov of course too... more on his little empire and where the money went with him is coming)

Read further, within COUNT ONE, paragraph hhhh, they note that in furtherance of the conspiracy, Hagen sent to the "GTX Global General Counsel" an completed 15c2-11 filing. WAIT, the GTX GLOBAL GENERAL COUNSEL? wasn't the general counsel EDWARD OVSENIK?

Yes, at the time of the filing being sent to him, on October 18, 2005, Ed was. But Ed was also listed as the President of the company and had already been posting and quoted in press releases as the president and officer (remember all that Yadio BS, and the press releases about Kim A Parker and the new finance team?). So it's unlikely the german army defense of "privilege" will apply.

Read further, jjjjj "on or about December 28, a GTX officer, after discussing the matter with Hagen and Brecher, caused GTX Global to publish a false 15c2-11..."

Government Wins Round 1 in Hagen Motions

David Hagen had, as documented in the previous posts from 9/25, 10/16 and 10/19, been trying to get his plea agreement (also posted here in this blog) suppressed. Well, the government has won round 1.

The foreign affidavits and submissions are admissible in the US Government v Bryan Kos and David Hagen case. This means that all the affidavits that are used to corroborate the wiretap information, the statements made by Mark Brecher and the still unidentified "CW" (confidential witness) are admissible and likely to add many nails to the coffin.

A couple of questions sparked some investigative work on Mark Hagen. Just like David and the Hagen spawn (Andrea and Derek "fat schmoo comedian wannabe") this guy is a real piece of work.

Mark Louis Hagen owned a satellite sales company called Proffesional Satellite. the installation industry knew this guy was as dirty as his thieving brother.

As someone noted in a comment to the post Mark Hagen "sold" Professional Satellite to an Indian company up in Northern California Nayna Networks. Nayna has been a penny stock for a long long time, but apparently they had enough stock and money to buy a non-complementary business.

A Brief Departure

With the "bail-out" bill being passed this week, Moveon.org and "The Daily Kos" targeting our own Liddy Dole and backing do-nothing Kay Hagan (despite the near spelling she is not related to now and future felon David Hagen) in a race much closer than it should be, Spammer Jeremy Jayne's conviction being (apparently) over turned (is David Brady going to use this to get out now too?), the David Hagen saga continuing, worthless fucks like Ivan Ivanov, Ed Ovsenik, Curtis Garth, the Hagen spawn Andrea and Derek getting away with all the shit chronicled in this blog, and more.. it just seems like the world is spinning out of control.

First, look where how we got here.

The current liquidity gridlock and extreme volatility washing across all of our debt and equity markets has caused me to do some reflecting on what I think some of the possible causes may have been. Obviously, mortgage lending took a reckless and unsustainable turn. This is what I believe has been the major catalyst for our current state of affairs.

In order to understand how this happened, a short history lesson is in order. In a word--regulation. Regulation driven by liberals and progressives, not free-market “deregulators” as the aforementioned would have you believe.

Pushed hard by politicians and community activists, the regulators systematically and deliberately altered financially sound lending practices. The mortgage market was humming along just fine when, in the late 1980s, progressives, in their traditional style of fixing things that aren't necessarily broken, decided that it needed to be “fixed.” Their complaint: Some ethnic groups got approved for mortgages at lower rates than others.

The shift began in 1989, when Congress amended the Home Mortgage Disclosure Act to force banks to collect racial data on mortgage applicants. By 1991, critics were using that data to paint lenders as racist by showing that minority applicants were approved at far lower rates. In fact, they found a racial disparity only by ignoring relevant data on applicants’ ability to make mortgage payments - such as their assets and credit history.

But the political pressure was intense - with few in politics or media eager to speak the truth. And then, in 1992, came a study from four researchers at the Boston Fed, which seemed to bear out the critics’ contentions.

That study was, in fact, based on quite flawed data - but the authors’ political, media and academic protectors stifled most serious criticism, smearing the reputation of one whistleblower and allowing the Boston authors to avoid answering serious academic challenges to their work. Other studies with different conclusions were ignored.

The very next year, the Boston Fed announced new requirements for banks - rules that have now turned out to be monumentally catastrophic: Adopt “relaxed lending standards” or risk being labeled as racists, and face serious penalties under the federal Community Reinvestment Act.

And now, Barney Frank apparently has a glaring, public and (so far) unprosecuted conflict of interest. From Fox News...

Now that Fannie Mae is at the epicenter of a financial meltdown that threatens the U.S. economy, some are raising new questions about Frank's relationship with Herb Moses, who was Fannie's assistant director for product initiatives. Moses worked at the government-sponsored enterprise from 1991 to 1998, while Frank was onthe House Banking Committee, which had jurisdiction over Fannie.

Both Frank and Moses assured the Wall Street Journal in 1992 that they took pains to avoid any conflicts of interest. Critics, however, remain skeptical.

"It's absolutely a conflict," said Dan Gainor, vice president of the Business & Media Institute. "He was voting on Fannie Mae at a time when he was involved with a Fannie Mae executive. How is that not germane?

"If this had been his ex-wife and he was Republican, I would bet every penny I have - or at least what's not in the stock market - that this would be considered germane," added Gainor, a T. Boone Pickens Fellow."But everybody wants to avoid it because he's gay. It's the quintessential double standard."

"C'mon, he writes housing and banking laws and his boyfriend is a top exec at a firm that stands to gain from those laws?" the aide told FOXNews. "No media ever takes note? Imagine what would happen if Frank's political affiliation was R instead of D? Imagine what the media wouldsay if [GOP former] Chairman [Mike] Oxley's wife or [GOP presidentialnominee John] McCain's wife was a top exec at Fannie for a decade while they wrote the nation's housing and banking laws."

Frank's office did not immediately respond to requests for comment.

Frank met Moses in 1987, the same year he became the first openly gaymember of Congress.

"I am the only member of the congressional gay spouse caucus," Moses wrote in the Washington Post in 1991. "On Capitol Hill, Barney always introduces me as his lover."

The two lived together in a Washington home until they broke up in 1998, a few months after Moses ended his seven-year tenure at FannieMae, where he was the assistant director of product initiatives.According to National Mortgage News, Moses "helped develop many ofFannie Mae's affordable housing and home improvement lending programs."

Critics say such programs led to the mortgage meltdown that prompted last month's government takeover of Fannie Mae and its financial cousin, Freddie Mac. The giant firms are blamed for spreading bad mortgages throughout the private financial sector.

Although Frank now blames Republicans for the failure of Fannie and Freddie, he spent years blocking GOP lawmakers from imposing tougherregulations on the mortgage giants. In 1991, the year Moses was hiredby Fannie, the Boston Globe reported that Frank pushed the agency to loosen regulations on mortgages for two- and three-family homes, eventhough they were defaulting at twice and five times the rate of singlehomes, respectively.

Three years later, President Clinton's Department of Housing and Urban Development tried to impose a new regulation on Fannie, but was thwarted by Frank. Clinton now blames such Democrats for planting theseeds of today's economic crisis.

"I think the responsibility that the Democrats have may rest more inresisting any efforts by Republicans in the Congress or by me when Iwas president, to put some standards and tighten up a little on FannieMae and Freddie Mac," Clinton said recently.

As long has been rumored, David did in fact discuss, review, enter into and sign a plea agreement way back in October, right after he was arrested. How do we know? Well, here's the agreement for all to see as part of a motion (was and still under seal) to deny bail in the original case

Pretty amazing stuff that David agreed to. He was looking at ACCEPTING 2 (two) 20year sentences. What happened? Did David think he could cut a better deal? Roll over on the others? (Ovsenik? Ivanov? Remember right following this plea agreement David fired his attorney, or rather, his attorney fired him (see previous post December 2, 2007 here in this blog). Then Brecher gets arrested and subsequently pleads guilty. Hagen and Bryan Kos are indicted (which prompted David's new "divorce" attorney to file a motion for bail, which is filed under the head of "TOO FUCKING LITTLE TOO FUCKING LATE") which in turn prompted the above Government motion.

Now, the government, as it tightens the noose on David Hagen, seeks to introduce the plea agreement.

Brecher is one of several individuals linked to four heavily promoted companies to be indicted for his role in a multimillion-dollar securities fraud and money-laundering scheme.Parallel investigations by the Securities and Exchange Commission in Florida and the Federal Bureau of Investigation in Charlotte, N.C., already have led to several arrests, including that of former U.S. Attorney Sam Currin who pleaded guilty to money laundering and obstruction charges. Brecher and GTX Global Chief Executive David Hagen were arrested earlier this year. The bill of information against Brecher alleges that Jaynes, Hagen and Brecher conspired to manipulate the stock of the company between December 2004 and October 2006. The government alleges that Brecher and others gained control of millions of shares of GTX Global, placed them in the names of offshore entities and hyped the stock. They are then alleged to have sold the stock in the demand they created with proceeds exceeding $30 million.

According to an FBI affidavit filed in U.S. District Court for the Western District of North Carolina, Brecher received between $6 million and $9 million as a result of sales of fraudulently promoted shares of GTX Global. A recently unsealed court document shows that convicted spammer Jeremy Jaynes has for almost two years been key in helping federal prosecutors make their case against several alleged co-conspirators in a multimillion-dollar securities fraud and money-laundering scheme.

Jaynes, a prolific Internet spammer, was charged in 2003 under a Virginia state law banning the bulk distribution of junk email. He was convicted in the state court and sentenced to nine years in prison.

Federal court documents unsealed earlier this month show that Jaynes, who has been under house arrest while appealing his spamming conviction, pleaded to one count of securities fraud in November 2006 and has been cooperating with the government since then.

Under his plea agreement, Jaynes faces a maximum sentence of 20 years imprisonment in the federal case. Documents filed in the U.S. District Court for the Western District of North Carolina, Statesville Division, show that Jaynes is scheduled to be sentenced on May 6.

Jaynes was featured in several Dow Jones Newswires "In the Money" columns for his participation in the illegal promotion of penny stocks, including Absolute Health and Fitness Inc. (AHFI) and Concorde America Inc. (CCND).

Criminal prosecutors in North Carolina have already nabbed several of Jaynes' co-conspirators, including former U.S. attorney Sam Currin. Currin, a former protege of Republican U.S. Sen. Jesse Helms, was once North Carolina's senior federal prosecutor and a former North Carolina Superior Court judge. He pleaded guilty to money laundering and obstruction charges and was sentenced to spend more than five and a half years behind bars.

The complaint filed against Currin and others followed in the footsteps of civil cases filed against promoters and entities associated with the companies by the Securities and Exchange Commission in the U.S. District Court for the Southern District of Florida in 2004.

Most recently, David Hagen, former chief officer of GTX Global, was arrested in New York after returning to the U.S. from the Bahamas where he had fled. Hagen is accused of selling stock at inflated prices and laundering his profits through bank accounts in the Bahamas, the Netherlands, Cyprus and the U.S.

Court documents show that an unnamed cooperating witness helped the government convince Hagen to return to the U.S.

The bill of information detailing Jaynes' involvement shows that from 2003 to 2006, he conspired with others, including Hagen, to manipulate the stock prices of publicly traded companies. The manipulation included the use of Internet search engine advertising, spam emails, Web sites, unsolicited faxes and voice-mail broadcasts to fraudulently tout stocks.

Besides Currin and Howell and Vernice Wolz, two accomplices in the money-laundering scheme already under arrest, the bill of information filed in Jaynes' criminal case points to several other targets of federal prosecutors.

"Mr. O," an unindicted co-conspirator from Kalamazoo, Mich., is Donald Oehmke. "Mr. K," an unindicted co-conspirator residing in Montreal, is Bryan Kos.

In the original case, which led to ongoing criminal prosecution, Kos and Oehmke were accused by the SEC of having pumped the stocks of Concorde America and Absolute Health and Fitness. The two stock promoters, without denying or admitting the charges, settled with the SEC and agreed not to violate securities laws.

Also mentioned in the complaint against Jaynes is "Mr. R," likely to be Jere Ross, a Florida lawyer who facilitated some of the money transfers outside the country. Finally, "Mr. H," likely refers to Hagen.

Federal prosecutors in North Carolina continue to march out alleged conspirators in a multi-million securities scam encompassing a handful of penny stocks.

Bryan Kos, a stock promoter who a few years back settled civil charges with the Securities and Exchange Commission, has now been indicted under one count of conspiracy to commit securities fraud and one count of conspiracy to commit money laundering.

David Hagen, founder and former chief executive of one of the companies which stock was unlawfully pumped and dumped, was also indicted under similar charges.

Hagen has been under arrest since he returned to the U.S. earlier this year. An arrest warrant has been issued for Kos, a U.S. citizen who resides in Canada.

Co-conspirators Jeremy Jaynes, Sam Currin, Howell and Vernice Woltz already pleaded guilty for their roles in the conspiracy.

Mark Brecher Joins David Hagen in Jail

Mark Brecher, the former secretary and tresurer of Vision Technology Corp (VSTC, aka GTXC, GTX Global, Gatelinx) is latest to fall. With Judge Currin, Howell Woltz, David Hagen, and now Brecher, this leaves only Edward "Ed" Ovsenik, Ivan Ivanov, Keri Keenan-Hagen and Curtis Garth as the remaining main co-conspirators. Trent Green, Leonard Martin (of Yadio fame) and the other "executives" who joined VSTC and said nothing as they walked away with cash for silence payments are also in the cross hairs of the feds. It is only a matter of time. Hagen is singing, the Fed's have reams of data and the dominos are falling left and right.

Ivan, call Gretchen and cut a deal, unless you're already running to Bulgaria. Annette Hagen nee DeFusco, call the US Attorney and save yourself and your kids from tax evasion and bankruptcy fraud charges. Curtis, just remember what it felt like to file chapter 13. Criminal Probe Into GTX Global Leads To New Arrest

A four-year-old securities fraud investigation into four heavily promoted companies continues to spell trouble for those involved.

Parallel investigations by the Securities and Exchange Commission in Florida and the Federal Bureau of Investigation in Charlotte, N.C., already led to several arrests, including that of former U.S. attorney Sam Currin who pleaded guilty to money laundering and obstruction charges. Currin was sentenced to spend 70 months in jail last year. The four companies are Absolute Health and Fitness Inc. (AHFI), Concorde America Inc. (CNDD) and Bio-Heal Laboratories (BHLL) and GTX Global Corp. (GTX).

One of Currin's accomplices, Howell Woltz, an officer of several financial firms used to transfer offshore millions in illegal gains, also pleaded guilty last year to a tax fraud and money laundering scheme.

Earlier this month, Mark Brecher, secretary and treasurer of GTX Global, was the latest to fall victim of the criminal probe. He was arrested in Florida and removed to North Carolina where he remains incarcerated.

Brecher's arrest comes three months after that of David Hagen, former CEO of GTX Global, who was apprehended last October after returning to the U.S. from the Bahamas where he had been hiding.

According to a court affidavit by FBI special agent Doug Curran, the government investigation was helped by a cooperating witness who took part in all four securities fraud schemes.

According to the affidavit, Brecher and others controlled several offshore corporations, including Laureate's Way Inc., Walcott Indies Ltd., Toubetskoy & Co. Ltd., Toussaint Liberte SA, Valcien SA and Intelligy Corp.

By using these entities, Brecher and others were able to move millions of GTX Global shares to Canadian brokerage firms, including Global Securities Corp., Union Securities Ltd. and Blackmonth Capital Inc.

Then with the help of misleading press releases and several promotional Web sites, Brecher and others were able to pump GTX Global's share price.

The FBI affidavit details how after the stock price rose in response to the fraudulent promotional activity, Brecher and others sold shares held in Canadian accounts for "tens of millions of dollars."

Brecher, Hagen and others then laundered their profits by transferring the funds to accounts at First Caribbean International bank in the Bahamas. These funds were then wired to other destinations, including accounts controlled by Hagen in the Netherlands Antilles and ultimately accounts controlled by others in the U.S.

According to SEC calculations, the pump and dump of GTX Global shares was extremely lucrative.

Based on available records, the SEC estimated that between Oct. 3, 2005, and May 17, 2006, Canadian brokerage firm Global Securities alone cleared sales for about 5.6 million shares of GTX stock with total proceeds of about $32 million.

According to the FBI affidavit filed in the U.S. District court for the Western District of North Carolina, Brecher received between $6 million and $9 million as a result of sales of fraudulently promoted shares of GTX Global. He held a majority of its profits in accounts in Switzerland, Panama and the Bahamas.

The North Carolina criminal case against Brecher, Hagen, Woltz, Currin and others followed on the heel of a civil case filed by the Securities and Exchange Commission in the U.S. District Court for the Southern District of Florida in 2004.

Without denying or admitting the charges, Kos, Oemke settled with the SEC. Under their respective deals with the SEC, both promoters agreed not to violate securities laws, they are barred from participating in penny stock offerings and enjoined from participating in unregistered stock offerings. As part of their respective settlements, Oehmke agreed to disgorgement and civil penalties of $1,454,484, while Kos agreed to repay $499,573.

It's unclear how many more people are in the FBI's sight.

Court documents have indicated in the past that Kos, a U.S. citizen living in Canada, and Jere Ross, a Florida lawyer who facilitated some of the money transfers, might be likely targets.

Meier, a local Mecklenburg County attorney (and co-chair of the community outreach committe for the Mecklenburg County Bar Association) has signed on to be David's attorney. Steven T Meier has succeeded in getting a perfunctory continuance. Just means David has more time in jail to ponder (worry about the showers) and get used to a long long time behind bars.

Attorney to David Hagen, "YOU'RE FIRED!"

Thats right, in a stunning filing the attorney's for David Hagen have fired their client. Citing "conflicts" they have sought to be removed from his case. "Conflicts" is classic lawyer speak for either a client who is total uncooperative, or, who is about to get on the stand and lie like the stinking dog that David Hagen is. My bet is on the the latter.

David, in a continuing show of chutzpah, most probably wanted a trial and was going to tell "his side" of the story. His attorney's, having reviewed all of the governments evidence knew that whatever David was going to say was another in his long list of bald faced lies. But attorney's are prevented from putting anyone on the stand that they know is going to commit perjury. Hence, "YOU'RE FIRED" to David.

Not too surprising that his attorney's had David on a short leash. This is the same law firm that David racked up over $200K in legal fees (defending himself against Rick Stefanik, among all the other civil suits... all documented here in this blog) that he not only didn't pay, but cost his then lawyer a place in the firm.

Originally a "plea hearing" was scheduled for 12/5. But, with his attorney's now gone like all the investors, partners, employees, friends and family's money, the hearing has been "continued" to a (as yet unannounced) future date. Until then, note that David Hagen is going to be spending a Christmas in jail. Enjoying the festive atmosphere in jail, and celebrating with dance, song, merriment and joy.

This is the newly unsealed "bill of information". Notice the aliases. Antonio Diaz? Must be some some fun for David in jail. "Hey Antonio. You look good in the shower like that. Come over here my little hispanic love child and show daddy some loving."

There is a lot more in this filing. 14 financial institutions documented and tracked. 68 (sixty eight) different transactions, all with amounts, who, when, and where documented. Adding up to an astonishing $30.9 MILLION DOLLARS that the US Government is now seeking as forfeiture.

In a quick (and hopefully painful) summary court hearing Friday, David Hagen was remanded to custody without bail.

First step in the long long long jail time for David Allen DeFusco Hagen. He's in jail where he belongs and is not getting out anytime soon.

Remember this is exactly how they flipped Howell Woltz (now serving 87 months in federal detention) and got him to divulge information on his co-conspirators.

Next up... ED OVSENIK, IVAN IVANOV, MARK BRECHER, ANNETTE HAGEN, KERI KEENAN-HAGEN, CURTIS GARTH and others. Now that David (and his new jail girlfriend Bubba) is in custody, you can bet the "singing" has begun.

STUNNING NEWS, in a just unsealed warrant (that was issued in January of 07) details of the indictment and warrant for the arrest of David Hagen.

9 (NINE) felony counts (almost as many counts as VSTC, under the "leadership of Ed Ovsenik had attorneys if you remember the postings earlier on this blog) including...

2 counts of money laundering
2 counts of conspiracy
wire fraud
frauds and swindles
and more...

In the warrant submission, the US Attorney details efforts dating back to late 2004 and early 2005. They list the shell companies Hagen, Brecher, and others used to move shares in VSTC/Vision Technology Corp and launder money from the proceeds of the pump-and-dump stock scam. They list the banks and countries David Hagen used to move the money, Netherlands (Dutch) Antilles, Cyprus and banks in the Bahamas before landing in banks controlled by Hagen and a "CW" (Confidential Witness). It details the stock promtions, web sites and plans. AND, it lists transcripts of conversations recorded by the CW (with the help of the FBI) of conversations the CW had with David Hagen detailing actual actions (moving shares to and from Yadio, timing of moves, etc) the false press releases and more.

PLUS, in an amazing detail, they have documents signed by all the scammers that was faxed to the old Gatelinx main fax number in Southern Pines with handwritten notes as to who gets what and how much each gets, the price the shares should hit and more.

NOTE, the take was over $30MILLION. And David took out about 25% (or between $8MILLION and $10MILLION)

Section 425.16, the court affirms the dismissal of plaintiff GTX Global Corp.’s (“GTX”) complaint, and awards defendant Andrew Left (“Left”) attorneys fees expended both in defending this suit and plaintiff’s appeal from the decision of the court below. That was bad, but then Annette Hagen is arrested for DUI (after crashing young Hagen's Hummer) and is sentenced on June 27

Annette Defusco-Hagen, driving while impaired, 60 days in jail, suspended, 24 months unsupervised probation, 24 hours of community service within 90 days and cost, comply with treatment order, $150 fine and court costs.

Then, in an amazing show of bravado and arrogance, David leaves the Bahamas on 9/26 and is promptly arrested in NY.

See the first 5 pages of how David got busted. He sent his luggage on ahead and the FBI, which was watching him in the Bahamas waited in NYC for him.

And, an image of the waiver of extradition. DAVID IS COMING HOME TO NORTH CAROLINA. Maybe he'll hook up with Howell Woltz, Vernice Woltz and Sam Currin (Already plead out GUILTY co-conspirators).

OH THE QUESTIONS WE HAVE...

1. Where's Yoga babe Keri Keenan... er.. Mrs. David Hagen? Is she still in the Bahamas? (Maybe Chuck Manning will be going there to "do" this Mrs. Hagen... he already did the ex-Mrs. Hagen Annette DeFusco)

2. Why aren't Ed Ovsenik, Ivan Ivanov, Curtis Garth or Annette Hagen mentioned anywhere in the documents? The Fed's are coming for them. Hey Gretchen, watch the airports. Ivan is gonna run to Bulgaria and Annette loves Europe. Shouldn't ole Ed Ovsenik be worried. he did that pay-for-play deal with the wall street reporter, issued the false press releases and then (in a clear case of bankruptcy fraud) sold the assets of VSTC after David and Keri took anything of value, sold it or took it to the bahamas (see all the earlier posts here)

3. What do the kids (Derek and Andrea) think of dear ole dad going back to jail AND, taking their meal ticket with them? It's only a matter of time before they (the Fed's) seize the assets David has been hiding in his kids names.

Previous post here showed the sqlminds.com and the www.visiontechnologycorp.com had the same IP and hosting... by Ivan's webcluster.com (Data Consulting Group) company.

Well, almost immediately after that gem was uncovered, Ivan moved his IP address.

I don't care about you, personally or othewise Ivan. Let's review.

You can't in one comment say you're the CTO and all the good things you did for Gatelinx/GTXC/VSTC, then, in the next say you don't realy do anything more that tech support.

You can't say there are no synergies between SQL Minds and VSCT, then turn around and tell everyone you're working hard on VSTC products (even so far as to quantify the amount of work and the number of people)

You can't one minute say you're not part of the scam, then the next let yourself be an officer of the company and a board member (liable for what is said, printed and done by others under the name of VSTC) and then try and claim the german army defense of "I was only following orders".

Ivan, you're a naive pawn. You've been used and are continuing to be used. All the fraud, misrepresentations etc., even if you didn't actively participate in, are on your hands too. That's how the law works. Its called conspiracy. And you are neck deep in it.

Think back... Govalin, Heelstrike... both fake and PR's/announcements/claims used only for the purpose of stock maniuplation. Yadio, that was dirty from day one and the paper trail and mis-steps I documented prove it, VizualCom? comeon. You bought back technology that never was something "they" owned? etc. etc. etc., and now you're not even mentioned as CTO by Ed.

You're about to be indicted as a co-conspirator. I don't care about you, Gretchen and the entire US Attorney's office doesn't care about you. All anyone wants is Hagen. If there are casualties along the way because people are naive or just plain stupid, no one cares. We only want Hagen ... and now Ed of course.

You? You're nothing. So help yourself protect your family and what little chance you have left. Run to the US Attorney and cut a deal for giving up Ed and Hagen. It's the only way for you.

Sorry to all who read, and rely on, this blog. What with the ice storms, power failures and like, it's been difficult to pay attention to these scammers.

The link above is old Ed Ovsenik doing a "pay-for-play" audio ad with wall street.net (The old wall street reporter did one with Gatelinx with Irving before). It's an interesting interview (notwithstanding the mispronounciation of Ed's name by the reporter or the clear attempts at scripted answers he gives)

Couple of notes...

1. First he tries to reaffirm that they (VSTC) bought technologies from "another company" (which is Vizual Corp) when in fact that is patently false. Vizual Corp was set up by Kelly Sparks, David Gust to BUY Gatelinx, not the other way around. No technology was ever transferred to Vizual Corp from Gatelinx, which means they (VSTC) couldn't buy the technology back....so, this is LIE NUMBER 1.

2. They say they're coming out with a "beta" next week. Hmmmm.. we've heard this before. Interesting to see it. Since, as documented ad nauseum in this blog the hope for this technology (which did show promise 3 years ago) is LONG GONE.

3. He also says they have 2 new technologies "in the pipeline"... the first is a hard drive recovery tool. WOW. Thats a market no one has ever thought of. And a hardware based solution to help with bandwidth usage. Oh yeah, companies like.. oh.. F5, Cisco, radware, citrix, Nortel, Juniper and MANY MANY others haven't thought of that before. DANGEROUS COMMENT NUMBER 1 GAZILLION... you can't tell people you've got products coming as a publicly traded company without repurcussions when what you say is exposed as lies.

4. They're (under the guise of "laying the groundwork for growth" ... and implied success.. for the company in the futre) developing relaltionships with their developers and consultants. Hmmmm.. weren't there SEVERAL press releases about these consultants. They're just now starting to develop relaltionships?

LIE NUMBER 2. They never had any developers so starting relaltionships with Ivan Ivanov's merry band of bulgarians, the KA Parker model train crowd and the McKitrrick's of the world do not count.

5. "whats the advantage to your technology Ed?" Blah Blah Blah the value of face-to-face meeting value. Nope, never heard of that before either. WHAT A TOOL. You're right Ed, you can see all this. Including you in a bright orange jail jumpsuit.

6. $13.95 a month is the price point. FREE it won't matter cause it (the Gatelinx/GTXC/VSTC technology) won't work

7. Key executives.. "right now we're starting small" Ed, the lawyer who over time and disassociated themselvs from the "previous company" (AKA Gatelinx, Gatelinx Global, GTXC and related entities as part of the scam) Mark Brecher a "long history of deals and dealing with financial issues.. so he's been able to help "us" raise money" That's right.. raise money through the illegal promotion of the stock... They're currently negotiating with someone to be CFO and get their reports in line to be something above the level of a "pink sheet company" (despite previous announcements... all of which are documented and debunked here)

NO OTHER EXECUTIVES ARE REFERENCED. Hey Ivan, you're not part of the inside team anymore? Run to the US ATTORNEY, you're going to jail. They're selling you out

Overall this sounded like a really inarticulate and over simplified recasting of all the old gatelinx materials that sparks, irving and the others produced. Ed Ovsenik, throughout this whole "interview" cannot even explain consistently what the technology might have been able to do, the terms (technology "regime".. thats REGIMEN you dolt) and more.

Beta test of their software next week. END OF MARCH to make it commercially available.
Later part of march an announcement of another beta test product
Likely announcements of "significant new customers for SQL Minds coming out" (who?, we all ask... does Ivan have more companies to use his stuff?)
Later part of the year multi-party users for the conferencing software

Last, and I won't blow the joy for you... listen to Ed's recomendations for investors. The technology is "out there".. and more. Call and ask questions.. e-mail him, increasing the amount of information on the web site which goes live this weekend. (can't wait) ITS CLASSIC AND PRICELESS and.. it'll be some of the final nails in the coffin for these scammers when they can't follow-through on any of it.

Andrea Hagen (pronounced.. with some affection ahn-dray-a) was wed in a lavish ceremony in the Bahamas. Remember, David Hagen and his ex-yoga instructor NOW NEW WIFE (and ex-VP of Marketing for Gatelinx/Gatelinx Global/GTXC and head of SMS Prayer) Keri Keenan-Hagen-DeFusco (I can bet Annette is thrilled) fled to the bahamas.. well they hosted the whole family.

Grandpa Roy flies out from La Jolla, Derek Hagen and his girlfriend Julia, Annette Hagen flies in from Southern Pines, Peter Schreiner (David's oldest and ONLY friend growing up.. and documented co-conspirator here in this blog) and David's slimeball brother Mark was there too.

Andie's Wedding: The Full Story
If you are not into reading a long story, move on to my review of Legend of Zelda: Twilight Princess. I actually don't think more then a handful of you will read this, even less read all of it. I think it is more so I can write it down while it is still fresh in my mind, so I can look back on it later.
The journey started on January 1st. The night before, Julia and I were out late singing and partying at The Idiot Box for New Years. My best memories of that night were singing Tom Petty with Steve and not embarrassing myself in the longform musical (even though I sang about corpses). That morning, we had to wake up early because we needed to be at the airport by 9:30 but it was an hour and a half drive away. The car ride was pretty uneventful. Julia put on her christian rock mix cd, and I told her everytime I heard the name Jesus, I was going to pull out my penis. I fell asleep before the name was spoken.We parked our car in the daily parking lot, and started heading for the airport. Just our luck, none of the buses came to the part of the parking lot that we parked in, so we had to walk the quarter mile up to the terminals. We got through sercurity just fine, but then I had to use the restroom. I walk in, and the smell was horrific. Then, the only open stall, someone took a dump all over the toilet seat. As I turned around to just use the urinal, there was a man, shirt pulled up and penis over the top of his pants infront of me. He was just standing there, looking at his weiner. Karma for my penis/music threat? You decide.

We finally got to our terminal. I bought some magazines for us (Julia US Weekly and me SHOCK!, which had a funny section on celebs falling down), and Julia played her Brain Age game. While waiting on our flight, I noticed something very interesting. The golfcart transportation things in the airport make different sounds. There were some that sounded like a dump trunk backing up with the beeep...beeep...beeep, while there were others that sounded like a metal detector near a coin with the bep bep bep bep bep. Very interesting.Finally we boarded the plane. My dad got us first class seats for the two hour flight. We were seats 1A and 1B, which was really nice because those are the first class of the first class cause nobody seats infront of you so you can put your feet up. As they start doing the safety demo, Julia leans into me to tell me something. I notice the flight attendant staring at her, so I point it out. As Julia looks up at her, the woman says with an attitude, "Thank you for your attention...". Oh, it was on now. This flying waitress was not about to talk down to my girlfriend, in first class no less. Later on, when she came back by to get our drink orders, I asked for a Diet Coke. Here is how it went down:
BITCH: Here is your Diet Coke
ME: Diet? I asked for a regular Coke. What are your trying to say?
BITCH: What?
ME: You have no right to put your views on me. I am happy with my weight!
BITCH: No no sir-ME: -No no ma'am! I am sorry that my apperiance is so disgusting to you!BITCH: Sir, you asked for a Diet-
ME:-Oh, I know I did. I was just kidding. Thank you for your attention....

For the rest of the trip, she did not ask us if we wanted anything else, which is good for her, since I saw those 45% reduced fat chips in her cart.

Customs into the Bahamas was no problem, except they didn't give us the form to get into the country on the plane, so we had to fill it out there. As we walked out of the airport, we saw my dad waiting for us. He took us to his house, which is where Julia and I stay at for the first two days of our trip. Only a couple days before, I learned that my father remarried in a secret ceremony, not telling any of my family, with his new girlfriend that he left my mother for about a year ago. Carrie, whihc is my new mother in law name, and Dad just tied the knot only about a few weeks before. They said their reason was so that they didn't because they didn't want to overshadow my sisters, Andrea's, wedding. Though, Carrie was originally not allowed at the wedding, but now, since she is our mother in law, my dad convinced Andie to let her come.When we got to the house, we said hello to my old pet cats, Sal and Annie, and Dad and Carrie made us a late lunch. I had a turkey sandwich and Julia had peanut butter and swiss cheese on Triscuits. I gave Dad his christmas gift, which was a DVD called The Promise, which was made by the guys who made Crouching Tiger. After that, Julia and I went and took a nap in the guest house until dinner. The guest house was really cool. Think of a circus tent shape. Now, inside is just one huge room with a bed, mini kitchen, sitting area, and so on. There is a seperate room for the bathroom, but in all, it is just two rooms.

After our two hour nap, Julia, Dad, Carrie, and I went out to dinner. I can't remember the name of the place, but it was really good Bohemian food. I ate conch fritters and grouper fingers. During dinner, we talked about my Dad's current plans on how to take over the world and his trips to Africa. After dinner, we headed back to the house and watched The Promise. Now, while Dad didn't like it too much, I really enjoyed it. I think if I was 14, it would probably have been my fav movie of all time. It was almost more like watching a video game then a movie. After the movie ended, I woke up Julia and we went to bed. Wow, what a long day.

The next morning, Carrie woke Julia and I up at around 10. We got ready, and were greeted by a gecko sitting right inside the bathroom and an anole right outside the guest house door. We went to the main house and ate pancakes and bacon (which Carrie burned to a golden black). Next, Julia and Carrie went out to do some errands and Dad and I hit the gym.

I have been to the gym with my dad in over 4 years, but I told myself that I was going to try and keep up with him. We did Bi's and Tri's. My dad is an animal. In almost every excerise, he was lifting the whole stack of weights. I kept up kinda good, but my the last reps, I was seeing starts and almost blacking out. After that, Dad and I went and picked up sandwiches and headed back to the house to eat lunch with the girls. I had myself a ham club and Julia had a melted bree cheese sandwich. Then, Julia and I sat down and watched some GSN. Andie, my sister, called and we made plans to have lunch with her the next day around 1pm. Eventually, Julia left with Carrie to go on some more errands and I fell asleep. When I woke up, Julia and Carrie just got back, and within an hour, it was time to go to dinner.

We ate at a place called Indigo. As you can guess, everything was blue. I had myself some raviolis and julia had the lobster. The only things I really remember about the dinner is there was a woman wearing a very strange outfit sitting at the table near us, and Julia telling Dad, "I figured it out, you think you are funny..." That's my girl!

After dinner, we went back to the house. We looked at pictures of Dad's trip to Africa and all the cool stuff he saw. I mean, he actually saw a pack of lions attack and eat an animal less then 100 feet away from him, and had the pictures to prove it. After picture time, we ate ice cream and watched tv until it was time for bed. Tomorrow is my dad's b-day!

Carrie, the night before, told us to be ready to go around 9 so that we could go on a glass bottom boat ride with my dad for his birthday before we had to check in to the Atlantis and have lunch with Andie. We set the alarm for 8. We woke up, got ready, and waited. 9:30 rolled around, so Julia and I decided to head up to the main house. Both Dad and Carrie were gone. I called my dad's cellphone, and he said they were on their way back home. Around 10, they get back, and we found out from Carrie that she forgot to check the boat times, so she would right then.

Julia and I found ourselves watching TV again, and we came across the best channel ever. It was called Nick GAS, and it was all the old gameshows from my childhood such as Legends of the Hidden Temple and GUTS. Suddenly, my cellphone rang, and it was Andie. She asked if we were ready for lunch. It was already 1pm! I told her that I would get dad to take us to the Atlantis to check in ASAP where she was. I also found out that mom "forgot" the gift I asked her to bring for dad for his birthday, which was a small japanese statue that she kept when they broke up that he loved alot.

We finally got to the Atlantis resort, and Dad checked us in. After that, we found my sister and my mom in the lobby of the hotel. They actually saw us come in, but my mom didn't want to see my dad, so they both hid. We went and ate at the Atlas, which I think has the best burgers on the island. Halfway through the meal, both my mom and my sister left, and we were left with my grandma and her boyfriend, who we crossed paths with on the way to eat.

After lunch (which took forever), we walked around, checked out the comedy club, but eventually ended up in mom's room. Both Andie and Mom were in there, finishing wedding baskets, and both in very bad stressed moods. Everyone who was coming to the wedding came that afternoon, and alot of people had their rooms bumped around because the World Poker Tour were in the hotel. As the night rolled on, we ordered room service, got an in-room movie (The Prestige, which was awsome), and then we went back to our room and went to bed.

The next morning, we had a huge brunch with all the people from the wedding. This was also Andrea's birthday (but she already opened the gift I got her before christmas). I met alot of Kevin's (Andie's fiance) family, and saw some of my family members I hadn't seen in years. Food was pretty gross, though the lady who made my omlette guessed what I wanted in it perfectly. After breakfast, we were all going to go down into the dig (underwater walkthrough with fishes all around you) but everyone just kinda went and did their own thing. Eventually, Julia and I met up with more family members down by the pool, and found a sign that said "Walk with the Sharks"....more about that later.

Around 4, it was time to get ready for the rehersal and dinner with the bridal party after. Since I only brought 1 bag of clothes (and it was a carry on), I had to wear my tuxedo pants and the white collar shirt since it was dress up. I did buy a pastel yellow tie with pastel blue flowers on it to wear with it though. It was so bad looking. I also bought Brian O'Sullivan's b-day gift. When we arrived at where my sister is to be married, it was beautiful. There were old ruins at the top of a hill with steps down to a wedding area right next to the ocean. We practiced for about 45 minutes, and then it was time for dinner.

We ate at a place called The Dunes at Ocean Club. I sat at the table w/ my dad, carrie (since my mom had to be seperated from them), Julia, and kevins parents. I love kevins parents. We had a blast talking about movies, fishing, and comedians of old during the whole meal. The food was alittle too fancy for me, so I really didn't enjoy it. After dinner, we went to a place called Taj Mahal for Andrea's surprise birthday party. The rest of the wedding party was there. This is also where I first saw my grandpa roy (who I love to death), and my dad's childhood friend peter, who I always saw as kinda an cool uncle. There was alot of drama going on between my mom and carrie, so when Julia said she was feeling sick, I was pretty ready to go home (she also puked all over the side of the limo as we pulled into Atlantis). We watched the movie Open Season, and went to bed, ready for the wedding the next day.

We woke up to my sister calling the room at about 10am, telling Julia that if she wants to get her hair and make-up done with the rest of the brides-maids, come up to her room when she can (even though the wedding wasn't until 5pm). But, there was one thing I wanted to do today before thinking about the wedding. Remember that sign "Walk with the Sharks"? Oh yea!Julia at first was really upset at me that I wanted to do this. She said I was crazy, but I convinced her to atleast come down to the shark tank and ask them how dangerous it was. When we got there, a family of 5 was about to go down, including 2 kids under 15. Julia asked the lady how dangerous it was, and she said not at all cause the bahaman reef sharks just ate 120 lbs of fish. She told us to watch the safety demo with the family that was about to go down. After watching that, and the 12 year old in there not scared, Julia decided that she would do it with me. I asked the lady if we could go, but she told us that there was a 3 day wait, and we were leaving tomorrow, but I asked her, since we already watched the safety demo, could we go quick after this last group. After asking the divers, she said that it would be ok.As I put on the underwater helmet to go down, suddenly it filled up with water. The guy said try again. Went down again, this time I was about 5 feet under, suddenly, it filled up again. I climb up the ladder so fast (cause the helmet weighs about 80 lbs and I can't swim with it on), and gasped for air. The guy said try again. I said no. My luck is that I would be 30 feet down with the sharks next time and it would fill up. The guys said that my chest was too big (kind way to say I was too fat) foir the helmet, and he refunded my 100 dollars.

Next up was Julia. At first, she refused to do it if I wasn't, but in the end, after I asked her to do it for me, she agreed. It was so cool watching her down there from outside the tank. She was smiles the whole time. She even saved a fish from being trapped under a grate. She is my brave little girl, but I am sooo jealous of her skinny'ness. They took lots of pictures that should be up online soon, so I am sure Julia will add it as her new profile pic when they do.

After that, it was time to get ready for the wedding. Julia went with the girls, and I met up with the guys at Kevin's room. We got our tuxedos on, and headed to the wedding. By the time we got there, everyone was there but the girls, even my uncle mark was there who I haven't seen in like 6 years. We got into our possitions and the wedding started.

Minute I saw my little sister wearing that wedding dress, I started to cry. It messed my mind up seeing my lil sissy getting married. The whole thing was beautfiul, even though the preacher started with an advertisement for "I Do: Wedding Planning". The best part was right as they said, You are now husband and wife, fireworks went off in the background, which I found out later from my dad cost 3000 dollars (which is probably what my whole wedding will cost).

The reception after was also wonderful. It was done at the world famous GreyCliff. The food was still alittle fancy for me though. One of the best parts of the night was when Julia danced with my father. After Andie's best friend and Kevin's brother Keeth (who is now one of my fav people in the whole world) were done with their heartwarming speeches, the wedding planner came up to me and asked if I could lighten the mood with a joke. I responded...okay....here is what I said:

"Ummm....hello?....uh....My name is Derek....for those who don't know me....uhhh...I am Andrea's brother. I was asked to come up here, and say a joke. Well, uhh...for people who know me...they know I am not funny...I am really nervous....my heart is beating really fast...bum bump bum bump bum bump....uhhh....yeah. All I can think to say is what my grandfather told me when I was a little kid. I think it sums up the night well. A Pelican's beak.....can hold more...then it's belly can."

Then I just handed off the mike. In the 60 person party, about 10 people laughed, 30 people looked in confusion, and about 20 looked at me as if I said the most insightful thing they ever heard. After dinner, the limo took over an hour to pick us up. During this time, I took a dump and my mom ripped out the panel in a golfcart so she could hotwire it. When we got back to Atlantis, most of the wedding party went to the Dragon dance club, but since we had to get up early in the morning for our flight, we went back to our room, watched South Park: Bigger Longer and Uncut, and went to sleep. Oh yea, Julia lost my phone.My mom told Julia and I the night before to bring by anything she would want her to send to us the next morning. At around 8:30am, after we packed and were ready, we called mom's room. No answer. We called again. No answer. We called 6 more times. No answer. We went to her room and pounded on the door. No answer. By this point I am starting to freak out. I got security to open the door. She had the chain on the door, so it meant she was in there. I screamed into the room. No answer. Now I am totally freaking out. I go upstairs to get my sister for support. She is totally calm and comes down and tells me and Julia to check the sliding door since she was on the bottom floor. Julia checked and they were both locked but by one, she could see her sleeping. Julia started pounding on the glass, saying "Please mama wake up", and she did! She was very drunk and hungover from the night before and told me to get the poop. Oh yea, Julia found my cellphone.

So, Dad picked us up from Atlantis, and Julia, me, and Grandpa Roy (who was on the same flight as us before he took a flight from Charolette to San Diego) went to the airport and said fairwell to Nassau. All in all, I really didn't have the best time, as you could probably tell, but it was nice to see people like my dad and grandpa roy and all. I am really tired cause this took so long to type (all day with breaks for Idiot Box practice and eating and tv), so good night, my friends.

This gives a new meaning to the term "dysfunctional". Of course, FELON and SCAMMER and INDICTMENT all have the same name of Ivanov, Ovsenik, Brecher, Garth, Keenan AND HAGEN.

SQL Minds SCAM, When in doubt, call it version number 1

That's an old adage in the software game. If you don't know you're market, don't know what you're gonna do and/or don't have the money to actually develop, market and sell legitimately... then, call it version number 1.

Let's just review, quickly SQL Minds release schedule...

First, VSTC/Vision Technology Corp, who owns 49% of SQL Minds, and (as is documented here) is intertwined in both management and staff, announced the acquisition of SQL Minds on August 22, 2006. Then the "beta" test of the SQL Minds software (since debunked as the "beta" was none other than Data Consulting Group one of Ivan's other companies) on October 16.

SQL Minds files with the state of North Carolina all the papers in July. So, from July to less than one month after the "beta test" announcement made by VSTC (not by SQL Minds... remember this... first announcements are from and only from VSTC)... Version 1.1. comes out. 11.12.2006 Version 1.1 Released - Sunday, November 12, 2006

YAY! Release the hounds! Signal the trumpeters. Raise the flags. Hmmm.. checking VSTC's web site and the financial web sites... Nope, just as I remember...No announcement from VSTC. No confirmation of anything about the "beta" test or the release of this product. (I told you.. remember. The first announcements were only from VSTC.. now? nothing)

But then, quickly after that comes Version 1.2 Released - Monday, November 20, 2006. WOW, 8 days after 1.1 is released, a new version is out, tested and ready. Notice this? (from sql minds own web site) "The latest release, 1.2 adds, 7 new reports, which brings the total report count to 50" (remember that... add 7, total now 50)

Then, 11 days later (man, this Ivan is a coding and developer machine!) 1.2a Released - Friday, December 01, 2006 Wait a minute. Wasn't "version 1.2" released earlier? Wouldn't this, if they were adhereing to accepted naming conventions be 1.2.2 or 1.2b?

Well, I'm not surprised... but check out this gem... again, from their own announcements... "The new 1.2a release adds 8 new reports to a new total of 53 reports." OK... lets see "ver 1.2" added 7 to get to 50. FIFTY/50 total. Version 1.2a adds 8 to get to 53. Did they subtract 5 reports? Or, did the new math from the 60's and 70's not make it to Bulgaria.

PLUS, since clearly there is no opportunity here... they had to add "A 3 months price promotion is in effect until end of Feb, 2007. Check out our pricing under Purchase on the main menu." to make any headway. They (SQL Minds) just like VSTC, have no discernible sales or marketing, no employees and no prospects for success.

And Plamen, no amount of posting on the SQL community blogs, web sites, forums and bbs's will help you.

But, even with the 3 new versions of the SQL Minds Companion.... there have been no announcements from VSTC. And, you'd think with them owning 49% they'd want to cross-promote and help ensure the success fo SQL Minds. Apart from the 49% they (VSTC/Vision Technology Corporation) own, there is the little matter that the President of VSTC is also on the board of SQL Minds, and the President of SQL Minds i the CTO of (and on the board of) VSTC.

Nevertheless, Ivan Ivanov continues to bang code like a fiend. THEN, a fourth release, Version 1.3 which fixes the bugs in 1.1,1.2 and 12a is released. Of course (and everyone who understands SDLC protocols) knows that bug fixes (which are usualy a patch or an extension to a version, not a new version) and the addition of "Support Forums added to the web site" require a new version. Version 1.3 is released on Tuesday, December 12, 2006 a mere 11 days after the previous versions.

Then, on 12/22/2006 (another 11 days) Version 1.4 is released. Two more reports added, small bug fixes. Ivan is a Machine I tell ya!

5 versions of a released product (in a short and astounding 40 days) comes from SQL Minds without a comment or report on the beta "customer" from SQL Minds, or any comment, announcement or story from VSTC on this resounding success.

HEY IVAN... what do you do for VSTC? Seems like a heckuva lot of coding on SQL Minds products and not so much on VSTC's. What's up with that? Don't you have a fiduciary responsibility (read this carefully Ivan) to ensure that VSTC is adequately, effectively and accurately communicating the status and performance of the company?

Smells like Enron stuff to me.. probably smells that way to the feds too.

CONFIRMATION.. SQL MINDS IS PART OF THE SCAM. The remaining part apparently. We've already uncovered where Ivan is (Tuesday, October 10, 2006 "Where in the world is Ivan Ivanov?") and documented where Ivan is in the scam and where he isn't in the on-going federal investigations and testimony provided by two of his cohorts (Ed Ovsenik and Curtis Garth) to a federal grand jury.

Ivan is now on the board as a director and officer of VSTC/Vision Technology Corporation.

Here's what we on the inside know to be the truth. Ivan was a hosting company in Charlotte that Gatelinx turned too after Hagen failed to pay the bills on the other hosting companies being used, after Rick Stefanik was fired, and after everyone else (developers, sales, marketing, support) were gone to "forklift" move the servers and to assist in "unraveling" the knot of Rick Stefanik's failed and overdone architecture. Since then, questions have arisen (asked and sometimes answered in this blog) about what the heck is Ivan actually doing.

DD and Richard Bennet, contributors to the blog and pissed off investors both, have tried to get answers, were promised beta versions of the VSTC software (previously known as the Gatelinx Communicator, Vizual Corp.'s VizTalk, etc.. and all documented here) and have asked questions about Ivan.

In this blog, we've tried to document what we know, what we find and what we can document. But, let's go to the proverbial horses mouth....

What does Ivan Ivanov say is his role in Vision Technology Corporation/VSTC, Data Consulting Group and SQL Minds?

In the blog post of 11/26 (Sunday, November 26, 2006 "VSTC down? and SQL lives?") Ivan confirms.. in his own words in e-mails to me...

".... a partner in Data Consulting Group and have been successfully running this company for over 10 years.I had a prior relationship with Gatelinx Corporation, supporting their network and data storage requirements for two years. When Gatelinx Global purchased the assets of Gatelinx Corporation they asked me to continue to support these requirements. When Gatelinx Global Corporation merged in to GTX Global I was brought on as Chief Technology Officer (CTO) of GTX Global. GTX Global changed its name to Vision Technology and I continue to serve as CTO overseeing the re-development of their software product and their IT requirements.SQL Minds is a privately held company that I run as CEO. Pretty much what we know.. and what we've previously documented. He's a consultant who got a position in the company he was "consulting" too, is the owner of DCG and CEO of SQL Minds. Notwithstanding the obvious conflicts of interest, and the "investment" that VSTC has made in SQL Minds (http://www.visiontechnologycorp.com/pdf/SQL%20Minds%20acquisition%20rev.pdf) ... there's still lots of questions... and now, VERY different answers.

In reports from phone conversations with DD, Ivan says he is "a Tech support person for the present company" Hmmm.... consultant, owner of DCG, CTO of VSTC/GTXC, CEO of SQL Minds, but he is now (just) "tech support". CTO/Director/Office rof a publically traded company who is tech support. (not suprising given they.. VSTC... has no employees, no product, no system, no technology, etc.. but still, comeon.

And, when pressed for information he repsonded that he is "unwilling to talk about anything with VSTC, he is just CTO and didn't want any inside info coming out"

WOW, a CTO/Director/Office rof a publically traded company unwilling to talk about his company. Red Flags anyone? Ivan is distancing himself from VSTC. It won't work. Ivan, you're part of this scam and the fed's know it. You can only hope to run back to Bulgaria.

So we don't really know what Ivan is doing now for VSTC, despite being the CTO and a Director/Officer of the company. We still don't know what SQL Minds is actually doing for VSTC, despite the announcement of services for VSTC and despite Ivan's own confirmation that SQL Minds and VSTC have nothing to do with each other.

We know what Ivan say's he's doing. We know what the press releases say he's doing. And we know, from the inside, what he was actually doing before the scam took hold.

So questions, questions, questions. I'll get the answers, I always do. Next up.. product, offers, market size/opportunity.. and more conflicting answers from Ivan.

Ivan offers to respond to anyone, although his curious responses and wanting people to call him bring pause to the offer. Take him up on it. Send e-mails, call.. drop by his house. Ask questions. Don't expect any answers, but ask them anyway. The fed's will ask tougher questions.

(since renamed VSTC/Vision TechnologyCorp and a further relationship with SQL Minds)

Since the VSTC announcement of SQL Minds' "beta test" (http://biz.yahoo.com/prnews/061016/clm509.html?.v=49) and, since that beta test was disclosed to be not of a real "beta customer" but of Data Consulting Group, one of Ivan Ivanov's companies (he is the CEO of SQL Minds, CEO of DCG and CTO of Vision Technology Corp/VSTC) .. which was all documented here (Thursday, November 09, 2006 "SQL Minds is up and running.. sorta") there's been more developments.

First, there have been 2 new versions of the SQL Minds "Companion". Version 1.1 was introduced on 11/12 and on 11/20 Version 1.2 was released. Hmmmm... if 1.1, which implies general availability, was released that means that the "beta" was sucessful no? And, you'd think the PR machine of Edward Ovsenik would have cranked out some kind of announcement. "Hey folks, the scam continues. DCG has completed a beta test of their own product" or something like that. But Nooooooo. Nothing.

SQL Minds is a privately held company that I run as CEO. We have developed a product that is unique and advanced in its capabilities.

SQL MInds negotiated an agreement with Vision Technology to have them finance the product, provide marketing and sales for when we go live, and as a result, we swapped 49% of the SQL Minds stock for stock in Vision Technology.

SQL Minds software is completely unrelated to the software that Vision Tech is developing, but this does not stop us from working together on two products.

Given than the product SQL Minds produces (as you say here) is "unrelated" to the VSTC core technology, and VSTC is financing the product and providing sales/marketing, where does the driver or decision for what get's done when lie? Does DCG receive funds or business from either (or both) VSTC and SQL Minds for the hosting services or consulting work you provide? I saw on the SQL Minds web site that DCG had provided the testimonial for the SQL Minds product. Is DCG the "beta" customer that VSTC announced? Thank you again for your response. Questions like... Can you tell me a little bit more about the beta customer(s) you have? If you're releasing version 1.1, and now 1.2 does this mean that the beta has been successful and you're moving to general release and availability? Who are you selling too and who is likely to buy the product? What marketing programs or campaigns do you have planned? What is the size of the SQL "Companion" market? Where is SQL Minds positioned versus the opportunity and the competition? How have you undertaken the market assessment and determined the sizing? What is your go-to-market strategy? VSTC says they are a channels sales company, are you going to be selling through their (VSTC's) distribution? If so, how many partners/resellers do they have? Are you selling directly to end-users? How is your product going to be complementary to VSTC's both in product and in marketin and sales, since we know (from your own words) that they (VSTC's "products" and SQL Minds) are "completely unrelated". What funding will VSTC continue to provide?

I'd love to see some info and answers on these and more questions. Maybe I'll try and get them....

Comeon Ed. Ivan. Anyone. Answer some questions. You've already answered some of them Ed in front of the Grand Jury. Hmmmm.. Ivan wasn't subpoena'd yet. Maybe he's being set up for the fall by David, Ed, Brecher and the gang.

HAS SHUT IT'S DOORS. Yep, either the business was just not scamming enough poor folks by offering SMS prayers... or the efforts around this blog have started to pay dividends (more on that later in this post).

Seems that Keri, a couple of weeks back, shut the business down, fired everyone, sold off everything in a fire sale and has gone back to the Bahamas. Shows who is really pulling the strings. David Hagen, offshore baron must still be calling the shots. No where, during this whole shut down, was Curtis or Ed to be found. Nowhere that is BUT THE GRAND JURY.

Common knowledge that both Edward C Ovsenik and Curtis Garth answered subpoenas to a recent Grand Jury and testified there. Hmmmm... how much would you pay to be a fly on the wall there?

Either the testimony of 2 of the people left to "run" the scam was canned and further protected the real leaders (Hagen, Woltz, Brecher) and bought those 2 time to figure a way out (my bet is on this option... Ovsenik believes Ivan has something with his SQL front end. He, Ed, is just too stupid to know there is nothing there and is still hoping VSTC will resurrect itself with SQL Minds, Ivan and his merry band of Bulgarians.

OR, option #2... Curtis and Ed really opened up some cans of worms. You gotta figure that with all that is documented here in this blog, and with the resources of the federal government, that the US Attorney had some interesting questions for these 2.

Either way.. while the wheels of justice and the US Government turn slowly, they do turn. It's just a matter of time.

Remember the question as to what Curtis Garth got for his legal exposure as it was only (listed) as 50,000 shares of GTXC? First, some obvious stuff...

Nowhere does VSTC acknowledge or document the relationship with SQLMinds, (http://www.visiontechnologycorp.com/about.htm) YET. SQLminds.com documented it (earlier today, but has since been removed) as SQL Minds, a subsidiary of Vision Technology Inc.

Notwithstanding that (apparently) no one wants to acknowledge any relaltionship (but it's plain to see), look who's who in the company. Plamen Slavov, realtor to the stars, is the product manager. And Ivan Ivanov is not only the CTO of VSTC, CEO/owner of Data Consulting Group, but he's also the Investor Relations contact for SQLMinds. WOW, that is a man of many talents.

The "Testimonials" page (plural, but they only have one testimonial) http://www.sqlminds.com/ProductInfo/Testimonials/tabid/58/Default.aspx does not attribute the testimonial to a company. Kinda hard to judge the veracity of it, when you can't tell who or what they are. AND, the testimonial (such as it is) begins with the line... "Data Consulting Group is a mid-sized company that provides dedicated managed server solutions as well as shared server hosting services. The company has a dedicated SQL Cluster for a large number of web site hosting accounts."

So, either the testimonial is about DCC, not SQLMinds.... OR, it's a "testimonial" FROM DCC to SQLMinds.

Data Consulting Group is the "beta" customer" ? DCC is owned by the CTO of VSTC, founder of SQLMinds (and still major shareholder) and the IR contact for SQLMinds? (documented here Tuesday, October 10, 2006 Where in the world is Ivan Ivanov?)

How can they be both the owner and beta customer, and write a testimonial? How many conflicts of interest are there? It's so many it's like looking at a "Where's Waldo" game. "Where's Ivan?"... he's there, and here, and there and there and ooops, over there too.

Dive deeper into select sections.. like.. hmm.. "support forums" and you'll find the stirring Q/A/board discussion of "how to .....? First, remember that SQL Minds is the company owned by the CTO Ivan Ivanov (documented here in this blog (Tuesday, October 10, 2006 "Where in the world is Ivan Ivanov?"). Which then purports to have a technology worthy of a beta test, documented here in this blog (Monday, October 16, 2006 "Vision Technology Announces a Beta test...").

Well, a new name surfaces, "Plamen Slavov" who is listed (or lists himself) as "Product Manager" of SQL Minds, responds to a simple queery about who and what is SQL Minds. His e-mail response was...

A couple of things "pop out" at you. First, he responds as if he's from SQL Minds, but the e-mail address is from webcluster.com? hmmmmm, isn't that the domain (webcluster.com)of Ivan's company, Data Consulting Group, LLC.. who is the registrar of "Visiontechnologycorp.com" (http://whois.domaintools.com/visiontechnologycorp.com).

And, SQLMinds.com is also registered by Ivan's Data Consulting Group. (http://whois.domaintools.com/sqlminds.com) Interesting to note that the domain gets registered in early July, and by August 22nd 2,050,000 shares of VSTC (plus operating funds never disclosed) change hands. MAN, that was fast work.

And, the phone number, "941-587-9240 Direct" which is supposed to go to the Carson City Nevada Address is a Sarasota Florida exchange. Not Carson City, the purported office of SQL Minds, nor of the DCC office in Charlotte North Carolina, nor of the VSTC "Home office" in Raleigh, NC either.

But, be that as it may, we ping him further and ask for the web site to get more info on SQL Minds, the company that is the "future" of VSTC. His response is...

Or should it be "Vision Technology Corp., left in the dust again"? Or maybe better, "Vision Technology Corp., who cares about SQL front ends? Answer the questions about your vaunted and core technology" Whichever, it's clear that (once again) the market opportunity for what VSTC says is it's core technoogy is past.

Back in the day, when Gatelinx (the predecessor to Gatelinx Global, which begat GTX Global, aka GTXC, which in turn begat VSTC/Vision Technology Corp.) touted it's peer-to-peer based VVoIP (multimedia over IP) technology.. that was firewall and NAT friendly and worked over the open internet (incorporating some basic QoS features) everything was (essentially) server based. Meaning a provider needed to spend big bucks to develop an infrastructure and architecture of servers and network to provide VoIP, Video over IP and any combination of them, and derivitaive uses such as file sharing, file transfer and the like.

Despite the repeated claims in their press releases... (http://www.keepmedia.com/pubs/PRNewswire/2006/05/25/1596778?ba=a&bi=1&bp=12and http://biz.yahoo.com/prnews/060821/clm039.html?.v=52 among many) And despite the initial and recent claims (VSTC claims) of having 2 (two) servers commercially available for this VizTalk/Communicator, etc. The beta test is of an SQL product.

And the beta test is not of their much ballyhooed "True" Artificial Intelligence.. Noooooooo. They tell the world NOTHING. Comeon' Ed, tell us something. Show us you're not the big lard butt dolt you appear to be. First "Train Buddies" now "SQL Companion" hmmmm, interesting.

1. SQL is now admitted publicly for the first time (despite being documented here already) that SQL was owned by Ivan Ivanov. Hmmmm. Correct me if I'm wrong, but wasnt Ivan the CTO of a publicly traded company, then sold a company that he owned to the publicly traded comapny for which he received compensation in stock from the original company? That sure seems like a real conflict of interest. And, I don't remember seeing any filings, disclosures or the like.

2. Ed, Ivan and Brecher all now get stock. Wow, thats a relief to know these guys who have been scamming everyone have a publicly documented chance to cash in more.

3. K.A. "trainbuddy" Parker now gets stock. He's a consultant, of dubious input. Any announcements, disclosures or postings as to what he's produced, done, recommended, consulted on or anything else? Of course not.

4. Who is this Mr. Hensley a "major outside consultant"? I don't remember any filings, announcements or disclosures there either.

5. Notice the vaunted finance and reporting team of McKittrick, Williams and Lysiak are nowhere to be found.

VSTC, whatever the "product" is a SCAM. And, their web site still lists no products or technology.

A couple of comments posted to the blog on "VSTC/GTX Global.. caught in the scam again" (Saturday, September 30, 2006) about who is Ivan Ivanov, CTO of VSTC.. er Gatelinx.. um. GTX Global... and some details about his involvement prompted some picture taking.

First, some history. Back in late 2004, as "Gatelinx" was trying to recover itself from Vype and (now federally indicted) David Brady... the local Southern Pines and Raleigh hosting companies had enough of the Gatelinx (now, through several name changes VSTC/Vision Technology Corp) company and David Hagen bouncing checks. The company did a "forklift upgrade" and moved to Ivan's hosting facility in Charlotte.

That address is/was... Data Consulting Group, LLC. 12918 Winget Road Charlotte, NC 28278 US 704-737-5633. He was listed as the resigtrar for www.gtxglobal.net, and is listed as the registrar for VisionTechnologyCorp.com

Both Stefanik and Brady touted this as "insane" and "it'll never work". Well, when Monday came and the old Gatelinx "beta" servers were back up and running, they were stunned. Ivan, for the next few months did a good job "reverse engineering" the architecture mess that Stefanik had engineered and in keeping the site/servers up and running. This was no easy feat. The stuff crashed hourly and was never stable enough for anything close to a deployment.

So, DCG, LLC.. Ivan's company was first a hosting company of last refuge. Then, he became a consultant (and his merry band of bulgarians... hence the original GTXC claims of a Bulgarian location/subsidiary) at $3K a month. Then, he ascended to CTO (after no one else was left and Kelly Sparks finally left) with all the pomp and circumstance.

But wait, what about his other address.. newly listed as 13726 Sledge Rd, Charlotte, NC 28278 , with the phone number of (704) 504-9890. Well folks, since that home is apprently either newly constructed or still under construction, that's probably where some of the VSTC/SQL Minds/GTX Global/Gatelinx scammed investors money is going or has gone. IT'S RIGHT ACROSS THE LOT FROM IVAN'S OTHER HOME/BUSINESS ADDRESS!

We know old Edward Ovsenik is still polishing this pig, but Ivan apparently is smart enough to engineer his own exit strategy and cash out a bit.

The death toll's ringing.. or is that just the sound of the GTX Global.. er the repurposed Gatelinx web site(s) going deaf to a "ping" to the site?

Maybe they didn't pay this bill (to Ivan Ivanov and his merry band of bulgarians) either. This means that the legacy of whatever the technology was is now truly dead and gone.

VisLtech.com is still "coming soon" and the "repurposing" of the Gatelinx info is apparently beyond the technical capacity of Ed Ovsenik and Mark Brecher. Ivan is out, he's gotten whatever money he's going to get and is worried more about being deported then looking to take the Gatelinx site and make it VisLtech.com.

How they started Gatelinx has always been a different story. They invested in and worked for his brother, who then stiffed him out of his percentage. They bought a call center company, they started in Virginia. Lots of stories. Some of which might even have some truth in them.

Lookie here.. David and Annette, convicted felons... this is their personal financial statements. Thrown all over Southern Pines all of this info was what was being used to try and secure either (or both) funding with promissory notes to keep the SS Gatelinx afloat and as leverage for some of the pending purchases of both Gatelinx and DishTVNow (Note: some ofthe pending deals were for MILLIONS, but apparently not enough millions when compared to the scam they have ... so far... been able to pull off)

Notice how the empire that was "Gatelinx".. which was built upon PrimeTV, that became the hosue of cards DishTVNow, which became GTX Global, then GTXC, then VSTC... whatever the name, the whole thing was a Hagen/DeFusco/Hauge Family Trust scame... and was leveraged to the hilt. They lived large, bought cars, expensive wine, private planes and more.. then stiffed anyone who ever worked with or for them.

Notice that the projected revenue for DishTV was $35M. Their SEC filings relating to the GTXC (now VSTC) scam said $14M (and change)...and they sold it for $500K. Watch for documents from 2 different time periods that show the same numbers, meaning the whole thing was cooked and just had re-purposed (new dates) for the information that was used.

But attention investors, ex-employees, partners, clients, vendors... these are the guys (David and Annette Hagen... and their kids too I suspect) who stole your money and now live in the Bahamas. AND, my prediction that there will be movement towards a cessation of operations.. due either to financial reasons (lack of any revenue or any hope of any revenue ever being a big one of course)

OR, for market assessment/viability reasons (since they don't have any technology that actually works, nor any developers who might make something work)... but what you're seeing folks is the first move. ...Get the stock under $1 and have it delisted... and then slip quietly into the night.

VSTC, GTXC/GTX Global, trying to hang on and turn a sows purse into a silk ear

Interesting spate of rumors, sightings and information coming out of the new VSTC homestead...The CEI building in Raleigh. VSTC has an office space, but the sign out front wouldn’t be going up for another couple of weeks. The name (from the reverse split) is Vision Technologies, but we will have to wait and see what final sign says.

The picture of the building (from google earth posted here August 1 "VSTC, oh how the mighty have fallen") is remarkably accurate. Ed Ovsenik is the only one there and everyone else has quit, or run off with whatever money they've taken out of the scam. Ivan Ivanov is still providing the CTO role and Mark Brecher is running the show.

Apparently my posts here about the "source code" to the product that has gone "missing" is confirmed. (see post in this blog on April 17, "GTXC GTX Global Gatelinx") Ovsenik is saying that they are still trying to get the source code from the developers and that Chuck Manning (former head developer and main squeeze of the former Mrs. Hagen) was still indirectly and potentially going to sell/give/whatever a functional multi-party solution.

Apparently, people are still holding out hope for the once vaunted technology potential. I guess taking out millions in a scam, running off to the Bahamas ahead of the law, partners, ex-employees and creditors wasn't enough.

Seems that David Hagen is putting pressure on Annette to tell Chuck to get the stuff done. Apart from the fact that everyone has been waiting for Chuck to get something done (other than Annette getting done that is)... it's interesting to think David Hagen is still involved and actively looking to be involved further. Annette and Chuck are off running around in NY somewhere.

Inside info on what they are selling (and I use that term loosely) the latest toolbar version of the old Gatelinx Communicator. Not VizTalk, or Yadio, or anything called Vision whatever...not anything GTX Global or GTXC.. nor heelstrike, govalin or anything else. What they're trying to "sell" is the old Gen 2 version of the Gatelinx product, the Communicator. (which, note, is a different version than what was shown at their second attempt at VoiceCon in Florida (That "showing" was the old "blue" version, the first version, of the Gatelinx Communicator)

In the June 04, 2006 post in this blog ("GTX Global/GTXC... the pump chronicled") I detailed the "pump and dump" tactics (blatantly illegal tactics) for pumping up GTXC/GTX Global. The claims were amazing... "Penny Stock To Gain 950% ·" "Analysis say $45" "Stock to gain 900%" and more.

With a simple google search of "RapidPennyStocks GTXC" returns an amazing 1530 promtions.

With a google search of "risingpennystocks GTXC" it returns quotes like "Huge Profits. GTXC $5, Analysts Say $26."

MAN, what a promotion. GTXC was FLYING. Analysts (who? I never saw a one) promised/promoted HUGE profits.

Then, on JULY 31, a name change to "better reflect the new direction of the company". AND, they say further in the release "anticipates the announcement of commercial agreements in the next few weeks."

WELL, if that wasn't more fuel for the pump-and-dump engine run by Oemke, Kos, Woltz (in jail) and now (apparently) run by ole Ed Ovsenik... I wouldn't know what would be. If they can promote GTXC as a $26 stock, or a $40 stock, or a $60 stock.. with upside of 900%, 950% or 1000% (all things they have said)... then ole VSTC should be a GOLD MINE..a certified winner.

BUT, look at the facts. Since the reverse split, the stock is now selling for under $2, or a split adjust price of under $1.

SLIP SLIDING AWAY.... again and again and again. The reverse split to try and save this POS ain't working. Anyone who couldn't find GTXC.pk (because of the lack of any marketing or disclosure in failed attempts to slink off to Raleigh and the trailer park they're occupying) ... apparently they found them. Volume up 10fold. And the price?

That means that, adjusted for the reverse split, GTXC/VSTC is now trading for $1.095. Scary. And to think, David Hagen and his cronies have taken out MILLIONS from this scam.

Interesting article in USA Today (McNewspaper) yesterday. Gatelinx started with promise.. it had a technology opportunity that could (emphasize "could") have been something. But, like other businesses, that promise and potential turned into a scam.

Remember those halcyon days of Gatelinx? Before the Prime TV debacle in April of 04. Before the GTX Global "acquisition in December of 04 (remember that date, interesting info and documents to come).. and then the GTXC/Vizual/Yadio "who's on first" program. But, back in the good ole days, Gatelinx ruled Moore County. They had the entire complex, cars in the full parking lot, the grill, PerfecTV "offices".. and more. Here's the before picture... from 1930 N. Poplar, Southern Pines, NC 28387

Their new address, 8024 Glenwood Avenue, Suite 205, Raleigh, NC 27612 is nothing better than a non-descript office stripmall type building. Here's the "after" picture... their current location.

Notice the difference? Some you can see... (no cars, no real "facilities.. heck they went from ~1000 employees to ZERO, what do you expect) And, some you can't see. You can't see David, his chippy Keri...or the ex-wife Annette. Cause they've blown town to the bahamas, taking vendors, ex-employees, partners and investors money with them.

GTXC GTX Global Dead Cat Bounce?

Volume up? Volume down? LOTS of activity and sell off last week and the week before...Turns out, the NASD changed the rules regarding mandatory closing out of short positiions on 7/11. (See NASD Rule 3210)

Before, GTXC wasn't reported as a threshold security, but on July 11 the rules changed, so 1) it becamse public that GTXC was heavily shorted and 2) the shorts had to close out their positions under the mandatory close-out provisions of 3210. (Another example of how these guys have been manipulating the stock and their positions)

So, the short squeeze pushed the shares up and may continue to do so until the stock is removed from the threshold list.

Recent announcement from GTXC (http://biz.yahoo.com/prnews/060707/clf035.html?.v=55) .. or rather, from the remains of GTXC says their moving their offices to Raleigh.

"This move will allow us to be closer to our developers, consultants, and customers as we work to bring new capabilities to our software, new technologies to the company, and establish a broader customer base for the company's products," stated Edward Ovsenik, President of the company.

First, ole Ed "easy" Ovsenik has had quite the run.. VP, General Counsel, Interim President and now President. I guess since he's be intimately involved in the scam, it's only logical that he's now speaking for the company.. ESPECIALLY, since ...

Mr. Brad Isom tendered his resignation, effective June 15, 2006, to attend to family matters back in Utah. The Board has accepted the resignation and is searching for a new CEO who will focus the company on building for the future with new officers and directors. Mr. Ovsenik will continue to manage daily activities of the company.

Got to be shortest, and quietest, tenure ever.. (http://biz.yahoo.com/prnews/060511/clth040.html?.v=47) Apointed effective May 15, and resigns on June 15. Why? Nothing there to manage? Nothing there technology wise? Nothing left of the proceeds of the scam?

OR... is the move to Raleigh, the resignation of Bradford "ghost" Isom. and Ed running the "daily activities" because David Hagen has taken anything of any value out of the SS Gatelinx, there is no more left in the POS scam and the fed's are closing in? It certianly isn't to get closer to the developers (there aren't any).. or customers.. (there aren't any) or consultants (there aren't any and they can't pay for them anyway) More laywers still than employees.

According to the filings, Ed (supposedly) does not own any of the stock.. working for a paycheck, week to week is good enough for him eh? Will be interesting to see if there are any 8K filings on this one.. Ed's "promotion" and Bradford's departure. They got the hired gun SEC lawyer Lysiak don't they? Should be all on the "up and up" now, right?

Ivan Ivanov now "confirmed" as the CTO.. despite being listed as the CTO from March/April on.. in their own documents and in the filings they have made. Can't they keep who's on first straight these guys?

Meanwhile.. David Hagen, founder, convicted felon, titular head of the company and leader of the scam...is off in the Bahamas.. his new house, his new boat (and I mean a BOAT.. we'll get pictures and the name soon).. and his old girlfriend apparently made it out of the states just ahead of the SEC and FBI.

Last.. Since, they now claim some outside help on the technology...

GTX Global has also retained the services of Mr. Kim A Parker, of K A Parker and Associates, to assist the company with future development of its technology by assisting with forward development of the current technology while leading development of new technology. The company is already reviewing the technical aspects of video signal compression technologies to determine more efficient means of delivering video through Internet Protocol (IP) methods.

It's time to review the "real" story behind the technology. WAIT.. I just read.. they're "reviewing the technical aspects".. and trying to "determine more efficient ways of delivering video through IP methods." HMMMM.. wasn't that always the "claims"? They already had the "winning" technology, no? (LOL)

Maybe Chuck is done bopping Annette long enough to finish the work on the MUST transport. We all know nothing is left of whatever promise the technology held. Watch for announcements (as the stock continues to tank and get pounded down) that says they're restructuring, or that the technology is not viable and theya re ceasing operations.

By the way.. no listings on any search engine for Kim A Parker, K.A. Parker, K A Parker and Associates.. not that this is surprising. I mean, if you're looking for technology leadership for "cutting edge" technologies, why would there be any track record, presence, paper trail, cites, papers, published articles, interviews or stories on someone? That's not important, and certainly not important for a viable concern like GTX Global.
